9. Delivery of goods
9.1. When ordering the goods, the Buyer may choose one of the methods of presentation of the goods specified in clauses 9.2 - 9.5 of the Rules. Terms of delivery and prices.
9.2. If the Buyer chooses the home delivery service at the time of ordering:
9.2.1. The buyer undertakes to indicate the exact place of delivery of the goods.
9.2.2. The buyer undertakes to accept the goods himself. Acceptance of the goods requires the presentation of a valid identity document (identity card, passport or a new model driving license). If the Buyer is unable to accept the goods himself and the goods are delivered to the address specified by the Buyer, the Buyer shall not have the right to make claims to the Seller regarding the delivery of the goods to the wrong person.
9.2.3. The goods are delivered by the Seller or his authorized representative.
9.2.4. The home delivery service fee does not include the delivery of the ordered goods. 9.3. If the Buyer chooses to pick up the goods at one of the Lithuanian post offices during the order:
9.3.1. The buyer can pick up the goods at one of the Lithuanian post offices. If the buyer does not pay the above fee, the goods will be returned to topmix.lt9.3.2. The ordered goods must be picked up no later than 3 (three) working days after the Seller has informed the Buyer by e-mail or SMS that the goods can be picked up.
9.3.3. The goods can be picked up not only by the consignee specified in the order, but also by another person specified at the time of placing the order. When picking up the goods, it is necessary to have a valid identity document (identity card, passport or a new model driving license) with the employee of the Lithuanian Post.
9.3.4. Pick-up service at Lithuanian post offices is not provided:
9.3.4.1. If the total weight of the ordered goods is more than 20 (twenty) kg.
9.3.4.2. If the general dimensions of the ordered goods do not allow to implement this service. In this case, the order of the product does not indicate that such a service is provided.
9.3.4.3. If when ordering the product, the information on the delivery methods does not indicate that such a service is provided.
9.4. The buyer can pick up the goods free of charge at one of the Stores. If the Buyer chooses the following method when placing the order:
9.4.1. The ordered goods must be picked up no later than 3 (three) working days after the Seller has informed the Buyer by e-mail that the goods can be picked up.
9.4.2. The goods can only be picked up by the person who placed the order or the person specified at the time of placing the order. When collecting the goods, it is necessary to have a valid identity document (identity card, passport or a new model driving license) with the Seller's employee.9.5. If the Buyer chooses the delivery of the Goods to the LP EXPRESS parcel self-service terminal during the ordering process:
9.5.1. Goods weighing less than 30 kg can be picked up at Omniva post offices or LP EXPRESS self-service terminals. Goods heavier than 30 kg are not delivered to post offices and self-service parcel terminals.
9.5.2. The shipment must be picked up from the Omniva ATM within 7 (seven) calendar days after the Seller has informed the Buyer by e-mail that the item can be picked up. The shipment must be picked up from the LP EXPRESS self-service terminal within 5 (five) calendar days after the Seller has informed the Buyer by e-mail that the item can be picked up.
9.5.3. Terms of delivery and fee applicable to the Buyer.9.6. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods. These terms are preliminary and do not apply in cases when the required goods are not in the Seller's warehouse and the Buyer is informed about the shortage of the ordered goods. By approving these Rules, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and agree on the terms and other conditions of delivery of goods. .
9.7. The Seller shall be released from liability for violation of the terms of delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties unrelated and / or independent of the Seller or due to circumstances beyond the Buyer's control.
9.8. At the time of delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the consignment and the product (s) and sign the delivery-acceptance document of the consignment. After the Buyer signs the delivery-acceptance document of the consignment, it is considered that the goods have been delivered in proper condition, there are no violations, the cause of which is attributable to non-factory defects, and no discrepancies in the product (s). If you notice that the packaging of the delivered product is damaged (wrinkled, wet or otherwise externally damaged), the product (s) is (are) damaged and / or the product (s) are not in complete condition, the Buyer must indicate this in the delivery-acceptance document and , in the presence of the Seller or his representative, to draw up a report of damage / non-conformity of the free-form consignment and / or the product (s). If the Buyer fails to do so, the Seller shall be released from liability for damage to the goods when the cause of such damage is not a factory defect and due to non-conformity of the goods only if these non-conformities can be identified during the external inspection.9.9. The risk of accidental loss of or damage to the goods passes to the Buyer from the moment the goods are handed over to the Buyer.
9.10. If, in accordance with Clauses 9.2 - 9.6 of the Rules, the Buyer does not collect the goods within the set deadline or fails to deliver them to the Buyer and the Buyer has paid for the goods and their delivery, the representatives shall contact the Buyer regarding another delivery time and / or method. If the Buyer still does not collect the goods or fails to deliver them, such goods shall be returned to the Seller, the order shall be canceled and the Buyer shall be refunded the bank charges applicable to the Seller for the bank transfer, delivery fee provided for in paragraph 8.7 of these Rules, if applicable.
9.11. If, in accordance with Clauses 9.2 - 9.5 of the Rules, the Buyer does not collect the goods within the set term or fails to deliver them to the Buyer and the Buyer has not paid for the goods, such goods shall be returned to the Seller and the order shall be canceled.
